Terms of Use

Purpose

These terms govern the use of Kliip, an interactive classroom board available at kliip.school. Using it, with or without an account, means accepting these terms.

They are completed by the privacy policy, which describes what happens to data, and by the legal notice, which identifies the publisher.

Who may use Kliip

The service is intended for adults engaged in teaching or educational supervision. A student cannot open an account.

The board is usable without an account. Creating one is optional and does not gate any tool.

What is free

The Kliip board is free to use, with no account and no time limit: the tools, one full class, attendance, balanced subgroups and embedding on another site are all included. What is free today stays free.

An optional annual subscription additionally opens the paid features. It takes nothing away from the free version, and will not make it paid without notice to you. Its terms of sale are in the next section.

The subscription: terms of sale

The Kliip subscription is annual and optional. It opens access to the paid features — additional classes, cloud backup and sync, fairness statistics, draw certificates, additional themes. Its price is shown on the pricing page: tax included in the European Union, tax excluded in Canada and the United States, as each market’s rules require.

The service is provided by Les Studios Geospotter — Sole proprietorship registered in Quebec, Canada, operated by François Soucy, NEQ 2282505058 — registre des entreprises du Québec. The sale itself is made by a merchant of record: a Paddle group company, determined by the country you buy from. If you buy from Canada, it is Paddle.com (Canada) Ltd, 22 Adelaide Street West, Suite 3400, Toronto, Ontario M5H 4E3. From the United States, it is Paddle.com Inc., 3811 Ditmars Blvd #1071, Astoria, New York, NY 11105-1803. From any other country, it is Paddle.com Market Limited, a company registered in England and Wales under number 8172165, with its registered office at 30 Old Bailey, London EC4M 7AU. Your invoice names the one that sold to you. Paddle collects the payment, charges and remits the applicable taxes and issues the invoice; the contract of sale is therefore between you and Paddle, whose buyer terms apply in addition to these.

• The subscription runs for twelve months from the payment.
• It renews automatically on its anniversary date, at the rate then in force, announced before the charge. In Quebec, the law does not allow a one-year subscription to renew automatically for another year: it ends on its anniversary date, we notify you in writing between ninety and sixty days before, and you choose whether to take it up again.
• It can be cancelled at any time from the “My account” page: the “Manage my subscription” button opens Paddle’s customer portal, where cancellation takes a few clicks, free of charge and with no reason to give. You can also request it by writing to contact@kliip.school. Cancellation takes effect at the end of the period already paid for, and access stays open until then. In Quebec, the Consumer Protection Act additionally lets you end it at any time with a refund of the unused part: we keep only the price of the months already provided and an indemnity that never exceeds the lesser of $50 or 10% of the price of the remaining months (sections 214.6 and 214.7).
• If a payment fails, access to the paid features stays open for a few days, while the charge is retried, and is then suspended; data already saved is not deleted as a result.

You have fourteen days after the purchase to withdraw and obtain a full refund, with no reason to give. This period restates the right of withdrawal provided by European law; we apply it the same way everywhere, including in Canada and the United States, where no rule requires it. After that period, a subscription already under way is not refunded pro rata, except in Quebec, where the law requires it as described above.

Refund requests go to Paddle, which collected the payment, or to contact@kliip.school, in which case we pass them on. Ending a subscription erases nothing: your classes, your draw log and the draws you have named stay visible and stay deletable by you; only the paid features stop being available.

Your account

• Give an accurate email address you can access: confirmation and password recovery go through it.
• Your password is personal to you. You remain responsible for what is done from your account.
• Tell us if you suspect someone else has access to it.
• You may ask for your account to be deleted at any time.

What you undertake to do

You undertake to use Kliip for what it is meant for, and not to:

• disrupt the service, work around it, or try to reach another person’s data;
• use it in a way that breaks the law, or that harms someone;
• extract its content in bulk by automated means;
• use it to humiliate, single out or expose a student.

On your students’ data, two undertakings matter especially, because that data stays with you and we cannot watch over it in your place:

• enter only what is needed to run your class, and nothing relating to a student’s health, religion, origin or private life;
• follow your school’s rules and the law applicable to school data.

Support markers are deliberately limited to “helper” and “to pair up”, with no free text. That limit exists precisely so that a diagnosis never ends up in the product. Do not work around it by repurposing another field.

Availability

We do our best to keep the service available, without being able to guarantee it. It may be interrupted for maintenance, after an incident, or because of a provider.

The service evolves: tools may be added, changed or removed. A removal that would cost you a feature you use would be announced in advance where possible.

Because your classes live in your browser, clearing the site’s data erases them for good, and we have no way to restore them.

Ownership

The Kliip name, the logotype, the interface and the service’s code are protected. These terms grant you no rights over them.

What you enter stays yours. We claim no rights over your class lists or your content.

The embeds provided may be inserted into a third-party site, provided the attribution link that comes with them is kept and they are not presented as a third-party product.

Liability

The service is provided as is. We do not warrant that it will be free of error, or fit for a particular purpose.

We cannot be held liable for the loss of data kept in your browser, for the use you make of the service, or for indirect damage.

Nothing in these terms excludes liability that cannot lawfully be excluded, in particular for gross negligence or personal injury. If you are acting as a consumer, your country’s statutory guarantees apply in any event.

Suspension and termination

You may stop using the service whenever you wish and ask for your account to be deleted.

We may suspend or close an account in the event of a serious breach of these terms, or of use that puts the service or other people at risk. Except in an emergency or where the law requires otherwise, you will be told the reason.

Governing law

These terms are governed by the law of the publisher’s place of establishment, stated in the legal notice.

If you are a consumer residing in the European Union, Switzerland or Quebec, that choice does not deprive you of any mandatory protection of your country of residence, and you keep the ability to bring proceedings before its courts.
